Cannabis packaging law is state law. Every state with a legal cannabis program has written its own requirements — and the details are different enough that what qualifies in one market may not pass inspection in another. California’s resealability mandate for edibles doesn’t exist in Colorado. New York’s exit bag rules differ from Illinois’s. Michigan’s handling of multi-serving products operates under a different framework than any of them.

The Federal Baseline Every State Builds From
Before the state-specific rules, there’s a federal floor. Under the Poison Prevention Packaging Act (PPPA), child-resistant packaging sold in the United States must meet standards set by the Consumer Product Safety Commission (CPSC). The two standards most commonly referenced in state cannabis regulations are:
- 16 CFR § 1700.15(b)(1) — the CPSC’s core child-resistant standard, defining what counts as significantly difficult for children under five to open within a reasonable time
- ASTM D3475 — the standard developed specifically for cannabis packaging, now required or recognized in most mature state programs as the applicable CR benchmark
Passing these standards is the minimum. States then layer their own requirements on top: which product types must be in CR packaging, whether packaging must be resealable after first use (lifetime CR) vs. single-use, whether exit bags are required at point of sale, opacity and design restrictions, and documentation requirements for operators and distributors.

What’s at Stake
State cannabis agencies treat packaging violations as license-risk issues — not minor administrative infractions. Depending on the state and the severity of the violation, consequences can include fines starting in the thousands of dollars per violation, mandatory product recalls, inventory destruction at the operator’s expense, and license suspension or revocation for repeat or egregious cases.
