California has one of the most mature and detailed cannabis regulatory frameworks in the country, and its packaging requirements reflect that. Every licensed cannabis business operating in the state — cultivators, manufacturers, distributors, and retailers — must meet packaging standards set and enforced by the Department of Cannabis Control (DCC). Non-compliance can result in fines, product seizures, or license suspension.

Does California Require Child-Resistant Packaging?
Yes — unequivocally. Under California Code of Regulations Title 4, Section 17412, all cannabis and cannabis products transferred to a distributor for retail sale must be in child-resistant packaging. There are no product categories exempt from this requirement.
The CR standard California references is 16 CFR § 1700.15(b)(1) — the federal Poison Prevention Packaging Act (PPPA) standard enforced by the Consumer Product Safety Commission (CPSC). Packaging certified to this standard must be significantly difficult for children under five to open within a reasonable timeframe, while remaining accessible to adults.
Lifetime CR vs. Single-Use CR — California’s Critical Distinction
This is where California’s rules get more specific than most states — and where operators most frequently make mistakes.
California draws a hard line between two categories of products based on how long the CR requirement applies:
Lifetime Child-Resistant Packaging (Required for Edibles and Orally Consumed Products)
The following product types must maintain their child-resistant properties for the life of the product:
- Edible cannabis products (gummies, chocolates, beverages, etc.)
- Orally consumed concentrates (tinctures, oils taken orally, capsules)
- Suppositories
For these product types, a standard zipper bag that is CR when first purchased but becomes easier to open over time as the closure wears does not satisfy California’s requirements. The packaging must remain functionally child-resistant every time a consumer opens and reseals it — for the entire shelf life of the product.
Practical implication: For edibles and orally consumed products, resealable zipper bags must be certified to maintain CR performance through repeated use. Single-use heat-sealed formats work only if each individual serving is individually packaged in its own CR container.
Exception: A package that contains multiple servings does NOT need to be lifetime CR at the outer package level, as long as each individual serving inside is individually packaged in CR packaging.
Child-Resistant Until First Opened (Permitted for Inhaled and Topical Products)
Cannabis products intended to be inhaled (flower, pre-rolls, vape products) and topically applied products may use packaging that is child-resistant only until the first opening — provided the package includes this specific statement:
“This package is not child-resistant after opening.”
This allows single-use and heat-sealed formats for flower and pre-roll packaging, as long as the label includes the required language.
What qualifies as CR under this allowance: California explicitly recognizes plastic packaging that is at least 4 mils thick, heat-sealed, with no easy-open tab, dimple, corner, or flap as child-resistant for single-serving inhaled or topical products. This is California’s recognition that heat-sealed formats at sufficient thickness satisfy CR requirements for these product types.
Additional Packaging Requirements in California
Child-resistance is the headline requirement, but California’s DCC mandates several additional packaging properties:
Tamper-Evident
All cannabis packaging must include a tamper-evident feature — a visual indicator that makes it clear if the package has been opened previously. Shrink bands, adhesive seals, and heat-sealed formats all satisfy this requirement, depending on the product format.
Opaque (Edibles Only)
Edible cannabis products must be packaged in opaque containers. The product must not be visible from outside the package. Amber-tinted bottles satisfy this requirement; standard clear bags do not.
Resealable (Multi-Serving Products)
If a product contains multiple servings, the packaging must be resealable. This applies in combination with the lifetime CR requirement for edibles — so multi-serving edibles need resealable, lifetime-CR packaging.
Not Attractive to Minors
California requires that packaging and labels not be designed to appeal to children. This is an aesthetics-level requirement — cartoon characters, bright candy-like colors, and imagery resembling children’s products are prohibited.
Exit Bag Requirements in California
California requires that dispensaries provide exit bags — child-resistant bags in which purchased products leave the store. Exit bags serve as a secondary layer of child resistance at the point of sale.
Exit bags must be:
– Child-resistant (meeting the same CPSC/PPPA standard as product packaging)
– Opaque
– Not designed to be attractive to minors
Many California dispensaries use resealable zipper-style CR bags for exit bag purposes. The exit bag requirement is in addition to, not instead of, the product-level CR packaging requirement.
